Facing a lawsuit in the crosswalk death of an 80-year-old pedestrian, the town is asking a Superior Court judge to rule in its favor before the case goes to trial. The accident took place in 2008, when Marie Martino was struck by a Ford van and killed in a crosswalk near the corner of West Plain and Mitchell streets, just down the road from her home. Two of her daughters have filed a wrongful death and negligence suit in Middlesex Superior Court in Woburn against the town and NStar seeking an undisclosed sum, citing both the loss of companionship and more than $18,000 in hospital and burial costs.
