Notice and preview of special Board of Selectmen meeting on Monday, August 16, 2010 at 7:30pm

The Board of Selectmen will hold a meeting on Monday, August 16 at 7:30 p.m. to discuss complaints filed by two residents (George Harris and Linda Segal) alleging violations of the Open Meeting Law.  As you may be aware, the process for filing complaints and seeking redress for alleged violations of the OML was amended effective July 1, 2010.  The board subject of the complaint must respond to the allegation within 14 days and forward a copy of the complaint and the response to the Attorney General.  Formerly, district attorneys investigated complaints and issued findings.

Mr. Harris alleges that the Board of Selectmen should not enter executive session to discuss litigation involving other town boards and committees when neither the selectmen nor the town have been specifically named as defendants, only another town board.  Specifically, he is challenging the right of the selectmen to discuss the litigation between the town’s Historic District Commission and Twenty Wayland, LLC, the developers of the Wayland Town Center project.  Ms. Segal alleges that selectmen violated the OML by discussing public business prior to the starting time of the posted meeting.  Selectmen will consider their response to these complaints which must be filed by August 19 without an extension from the Attorney General’s office.

The meeting will be broadcast live and taped for rebroadcast by WayCAM.  The meeting begins at 7:30 p.m. in the Selectmen’s Meeting Room at Town Building.
